Please read these Terms carefully before using our services.

Definitions

“WBL-DEV”, “we”, “us”, or “our” refers to Wilhelm Burger trading as WBL-DEV and includes contractors and freelancers engaged on a project basis where required. “Client” refers to any individual or business engaging our services.

Agreement

By requesting, accepting, or using our services, the Client agrees to be legally bound by these Terms & Conditions.

Scope of Services

We provide WordPress website design, development, and related services as agreed per project.

Any services not explicitly agreed in writing are excluded and may be quoted separately.

Logo design is not included in website packages and is offered as a separate service. Where required, logo design may be fulfilled by a third-party design partner. WBL-DEV remains the primary point of contact for the Client.

Project Commencement & Payment Structure

A 50% deposit is required to secure and commence any project. Work will not begin until the deposit has been received.

The remaining 50% balance is due upon project completion and prior to website launch, handover, or transfer of access.

The deposit secures production time and reserves a dedicated project slot. If the Client cancels after work has commenced, the deposit will be applied towards work completed and any reasonable costs incurred. Any remaining balance of the deposit, where applicable, will be refunded in accordance with section 13 (Cancellation & Refund Policy) below.

“Commencement of work” includes onboarding, project planning, design setup, wireframing, or any development activity.

The deposit secures production time and reserves a dedicated project slot.

Client Responsibilities

The Client is responsible for providing accurate and complete content, materials, and instructions required for the project.

Delays in providing required information may result in project delays, for which WBL-DEV is not responsible.

Revisions & Scope Control

Reasonable revisions are included during the agreed review phase.

Any work outside the agreed scope, including additional pages, features, or redesign requests, will be quoted and billed separately.

Payment Terms

All invoices are due and payable immediately upon issue unless otherwise agreed in writing.

Failure to make payment may result in suspension of services, withholding of deliverables, or project termination.

No ownership, access, or transfer of website files, assets, or deliverables will occur until full payment has been received.

Monthly Retainer Services

Monthly retainers provide ongoing maintenance, updates, and support as agreed.

Retainers are billed monthly in advance and are payable immediately upon invoice.

Failure to pay may result in immediate suspension of services.

Retainers may be cancelled by either party with 30 days written notice unless otherwise agreed.

Unused time or services within a billing period do not roll over.

Hourly Support Services

Ad-hoc support is billed at an hourly rate, with a minimum charge of one hour.

Time is calculated based on all work performed, including communication, investigation, and implementation.

Work may commence upon request, and invoices are payable immediately upon issue.

Third-Party Services

We may use third-party providers such as hosting, domain, or plugin services.

We are not responsible for their performance, pricing, availability, or policies.

Data & Hosting Responsibility

Unless otherwise agreed in writing, the Client is responsible for backups and data integrity.

WBL-DEV is not liable for data loss, security breaches, or service interruptions.

Limitation of Liability

To the maximum extent permitted by law, WBL-DEV shall not be liable for any indirect, incidental, or consequential damages, including loss of profit, data, or business.

Cancellation & Refund Policy

Either party may cancel or terminate the services by providing written notice. If the Client cancels before work has commenced, any deposit paid will be refunded, less any payment processing or bank charges where applicable.

If the Client cancels after work has commenced, WBL-DEV may retain or charge a reasonable amount to cover work completed, time spent, third-party costs incurred, and any commitments made in relation to the project, in accordance with the Consumer Protection Act, 2008.

Any remaining portion of the deposit, after deducting these reasonable costs, will be refunded where applicable. Completed services, approved work, and digital deliverables that have already been supplied are non-refundable.

Turnaround Times

All timelines are estimates and depend on Client responsiveness and timely delivery of required content.

Affiliate Disclosure

This website may contain affiliate links to third-party services, including domain registration and hosting providers.

If a Client purchases services through these links, WBL-DEV may earn a commission at no additional cost to the Client.

Recommendations are made in good faith.

Any agreement entered into with third-party providers is solely between the Client and the provider.
WBL-DEV accepts no liability for their services.

No Guarantees

We do not guarantee specific results, including SEO rankings, traffic, or business outcomes.

Privacy

Personal information is handled in accordance with our Privacy Policy.

Governing Law

These Terms are governed by the laws of South Africa.

Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including power outages, internet failures, or third-party disruptions.

Intellectual Property

The Client confirms that they own, or have obtained all necessary rights and licences to use any text, images, logos, videos, trademarks, fonts, or other content supplied to WBL-DEV.

The Client indemnifies WBL-DEV against any claims, damages, or legal costs arising from copyright infringement or unlawful use of materials supplied by the Client.

Ownership of the completed website and custom work transfers to the Client only after full payment has been received. WBL-DEV retains ownership of any pre-existing code, development tools, templates, frameworks, and reusable components used during development.

Portfolio & Marketing

Unless otherwise agreed in writing, WBL-DEV may display the completed project, the Client's business name, logo, and website screenshots within its portfolio, social media, and marketing material for promotional purposes.

Browser Compatibility

Websites are developed to function correctly on current versions of major modern web browsers. Compatibility with obsolete browsers or unsupported devices is not guaranteed unless specifically agreed in writing.

Project Acceptance

Upon notification that the project is complete, the Client shall review the work and notify WBL-DEV of any issues within 7 calendar days. If no issues are reported within this period, the project shall be deemed accepted.

Software Licences

Websites may include open-source software and third-party themes or plugins that are subject to their respective licence agreements. Unless otherwise agreed, ongoing licence renewals remain the responsibility of the Client.

Project Delays

If the Client fails to provide required content, approvals, or feedback for more than 30 days, WBL-DEV may place the project on hold. Work may be rescheduled based on availability and additional charges may apply where significant re-planning is required.

Website Security

While reasonable security measures are implemented where agreed, no website or online service can be guaranteed to be completely secure. WBL-DEV is not responsible for attacks, malware, hacking, or vulnerabilities introduced by third-party software, hosting providers, or actions taken after handover.

Warranty Period

WBL-DEV provides a 30-day warranty from the date of project completion to correct defects directly related to the original development work. This warranty does not cover changes requested by the Client, third-party updates, plugin or theme incompatibilities, hosting issues, or modifications made by anyone other than WBL-DEV.

Access Credentials

The Client is responsible for securely storing all usernames, passwords, licence keys, and access credentials provided after handover. WBL-DEV is not responsible for any loss resulting from unauthorised access after delivery.

Confidentiality

Both parties agree to keep confidential any non-public business, technical, or commercial information obtained during the course of the project, except where disclosure is required by law.
